Refund Policy

1. Scope of This Policy

This Refund Policy applies to all purchases made on genius.us.org and its subdomains (the "Service"), operated by GENIUS.US.ORG LTD, Office 4, Suite C2, Orion Mall, Palm Street, Victoria, Mahé, Seychelles ("Company", "we", "us"). By completing a purchase, you confirm that you have read, understood, and agreed to this Refund Policy, our Terms & Conditions, and the pricing, trial, and automatic-renewal terms presented to you on the website, on the checkout page, in your order confirmation email, and in your account area.

2. Billing Terms You Agree To at Checkout

Our billing structure is disclosed clearly and conspicuously before any payment is taken:

  • Trial: $0.99 (incl. VAT) grants 8 days of full access to the Service, including immediate delivery of your IQ score, performance report, and certificate.
  • Automatic renewal: unless you cancel before the end of the 8-day trial period, your subscription automatically converts to a monthly subscription of $39.95 (incl. VAT), billed every month to your payment method until cancelled.
  • Cancellation: you may cancel at any time, free of charge, via the Cancel Subscription page, from your account area, or by emailing [email protected]. Cancellation stops all future charges and takes effect at the end of the current billing period.

You are solely responsible for managing your subscription and cancelling before your renewal date if you do not wish to be charged. These terms are displayed throughout the website, during checkout, in your confirmation email, and in your account area, and you expressly acknowledge them when you purchase.

3. Trial Fee Refunds ($0.99)

The trial fee pays for digital content that is delivered to you immediately and in full (your IQ score, report, and certificate). By purchasing, you expressly request immediate performance and acknowledge that, once the digital content has been delivered or accessed, you lose any statutory right of withdrawal to the extent permitted by law, and the trial fee becomes non-refundable.

As an exception, you are eligible for a full refund of the trial fee if all of the following conditions are met:

  • This is your first trial of the Service, on your first account;
  • No previous refund has been issued to you, your account, or any associated account;
  • A verified technical failure on our side prevented you from accessing your results, and our support team was unable to restore access;
  • You have not violated our Terms & Conditions; and
  • Your request is submitted through an official support channel within 30 days of the transaction.

4. Subscription Renewal Charges

Subscription renewal charges are final once processed and are non-refundable, except in the limited circumstances listed in Section 5. In particular, forgetting to cancel before your renewal date, not using the Service during a billing period, or no longer wanting the Service does not entitle you to a refund of a charge that has already been processed.

If you contact us after a renewal charge because you intended to cancel, we will immediately cancel your subscription so that no further charges are made, and confirm this to you in writing. Your access remains active until the end of the period already paid for. The renewal terms were disclosed to you before purchase and accepted at checkout; the processed charge itself remains valid and final.

5. Limited Circumstances Where Refunds Are Granted

A refund of a subscription charge will be issued only in the following cases:

  • Service downtime: the platform was completely unavailable for more than 24 consecutive hours (excluding planned maintenance and events beyond our reasonable control), and the outage is documented by us.
  • Verified technical issues: a technical problem on our side blocked access to core features of the Service, was reported to support within 30 days of the charge, and was confirmed by our support team and not resolved within a reasonable time.
  • Billing errors: duplicate charges, charges in an incorrect amount, charges processed after a confirmed cancellation, or charges we are unable to attribute to a purchase you authorized. These are always corrected and refunded in full.
  • Legal requirements: where a refund is mandated by applicable consumer protection law in your country of residence (see Section 9).

Outside these cases, refunds may be issued only in exceptional circumstances, in the Company's sole and absolute discretion, and any such goodwill refund does not constitute a waiver of this Policy or create any entitlement to future refunds.

6. Situations Not Eligible for a Refund

For clarity, refunds will not be provided for:

  • Failure to cancel your trial or subscription before the next billing date;
  • Unused time remaining after you cancel your subscription;
  • Non-use or partial use of the Service during a paid billing period;
  • Change of mind, personal preference, or no longer needing the Service;
  • Dissatisfaction with your IQ score or test results;
  • Temporarily limited functionality during scheduled maintenance or updates;
  • Issues caused by your own device, browser, internet connection, or email provider;
  • Charges older than 30 days at the time you first contact us, unless a longer period is required by applicable law; or
  • Accounts that have violated our Terms & Conditions (including fraud, abuse, or misuse of the refund process).

7. How to Request a Refund

Refund requests must be submitted through an official support channel:

  • Email: [email protected] (available 24/7/365); or
  • The contact form on our website.

Please include:

  • The email address linked to your account;
  • The date and amount of the charge (or your payment confirmation / transaction reference);
  • The reason for your request; and
  • Any relevant supporting documentation (e.g., screenshots of a technical issue).

We aim to respond to and process all refund requests within 3 business days. Requests made through unofficial channels (e.g., social media) are not considered validly submitted.

8. Refund Payment Method

Approved refunds are issued exclusively to the original payment method used for the transaction, normally within 5–10 business days of approval, depending on your bank. We cannot issue refunds to a different card, bank account, or payment method. If your original card has expired or been closed, the refund will still be sent to it and your financial institution will route the funds in accordance with its own policies — this is outside our control.

9. Your Statutory Rights

Nothing in this Policy limits any consumer rights that cannot be waived or limited under the laws of your country of residence. In particular:

  • EU/EEA & UK: you normally have a 14-day right of withdrawal for online purchases. For digital content, this right lapses where you have given express consent to immediate delivery and acknowledged the loss of the withdrawal right — which you do at checkout when your report is delivered instantly. The withdrawal right continues to apply to any part of the Service not yet performed.
  • Brazil: consumers have a 7-day right of repentance under Article 49 of the Consumer Protection Code (CDC) for purchases made online, which we honor in accordance with Brazilian law.
  • Other jurisdictions: where local law grants mandatory refund or cooling-off rights that exceed this Policy, those rights prevail for consumers in that jurisdiction.

10. Chargebacks & Payment Disputes

If you believe a charge is incorrect, contact us first at [email protected]. Our team resolves genuine billing issues quickly — almost always faster than a bank dispute.

  • Initiating a chargeback for a charge that was validly disclosed and authorized (including auto-renewal charges accepted at checkout) constitutes a breach of our Terms & Conditions.
  • We actively contest unwarranted chargebacks and will submit our records as evidence, including checkout disclosures you accepted, your IP address, order confirmation emails, access logs, and Service usage history.
  • Accounts associated with a pending or upheld unwarranted chargeback may be suspended or terminated, and any digital content, certificates, or reports may be revoked.
  • We reserve the right to refuse future service to, and to recover costs and dispute fees from, customers who file fraudulent or abusive chargebacks, to the extent permitted by law.

11. Changes to This Policy

We may update this Refund Policy from time to time. The version in force at the time of your transaction applies to that transaction. Material changes will be posted on this page with an updated "Last updated" date.
